TERMS & CONDITIONS – CRUZY CAR RENTAL AGREEMENT (Samoa)
1. Vehicle Condition, Damage and Loss
1.1 The vehicle is provided in good working condition. The Hirer must return the vehicle in the same condition, except for fair wear and tear.
1.2 The Hirer is responsible for all damage, loss, theft, or vandalism to the vehicle occurring during the rental period, regardless of fault, unless otherwise agreed in writing.
1.3 The Hirer is liable for all repair costs, including parts, labour, towing, and loss of use until the vehicle is operational again.
1.4 Any damage not reported at the time of return will be deemed the Hirer’s responsibility.
2. Loss or Damage of Keys
2.1 The Hirer is fully responsible for any lost, stolen, or damaged keys, including electronic remotes.
2.2 Replacement costs, reprogramming fees, and any towing caused by lost keys will be charged to the Hirer. This cost will be determined at the time of discussions depending on the issue in relation to the key and type of key.
3. Cancellations
3.1 Cancellation prior to collection of the vehicle must be made at least 48 hours before the hire period begins. If you wish to cancel 48 hours prior, no cancellation fee will be charged.
3.2 Late cancellations less than 48 hours prior to, may incur a cancellation fee up to the value of three full days of rental, unless otherwise specified in the booking confirmation.
3.3 “No-show” bookings will be charged the full booking amount.
4. Breakdowns, Incidents and Accidents
4.1 The Hirer must immediately notify Cruzy Car Rentals of any breakdown, mechanical issue, accident, or incident, regardless of severity.
4.2 No repairs or modifications may be carried out without the Company’s prior approval.
4.3 In the event of an accident, the Hirer must obtain details of all parties involved and notify local authorities if required.
5. Responsibility for Tickets, Fines and Infringements
5.1 The Hirer is solely responsible for all fines, tickets, traffic infringements, parking penalties, towing fees, and any legal consequences incurred during the rental period.
5.2 An administrative fee may apply for processing infringement notices.
6. Flat Batteries, Flat Tyres and Mechanical Failure
6.1 Flat batteries caused by driver negligence (e.g., leaving lights on) are the Hirer’s responsibility, including jump-start or call-out fees.
6.2 Flat tyres caused by punctures or misuse must be repaired or replaced at the Hirer's cost.
6.3 Mechanical failures not caused by misuse will be remedied by the Company at no cost to the Hirer. The Hirer must stop driving immediately if a mechanical warning arises and contact Cruzy Car Rentals as soon as practical.
7. Cleanliness of Vehicle
7.1 The vehicle must be returned in a reasonably clean condition.
7.2 Excessive dirt, sand, stains, spills, pet hair, or odours may incur additional cleaning fees.
7.3 Smoking is strictly prohibited in all rental vehicles. Any evidence of smoking, including smell, ash, or burns, will incur a deep-cleaning and deodorizing fee.
8. Fuel Policy
8.1 The vehicle will be supplied with a full tank of fuel at the start of the rental period.
8.2 The Hirer must return the vehicle with a full tank of fuel.
8.3 Refuelling charges will apply if the vehicle is returned with less than full.
9. Use of Vehicle
9.1 The vehicle may only be driven by persons listed and approved on the rental agreement.
9.2 The Vehicle may only be driven by those who hold a “Samoan temporary Licence” Cruzy Car Rentals will arrange the issuing of a temporary licence at a fee of WST $21.50 per person
9.3 The Hirer must not use the vehicle for:
- illegal activities
- towing, racing, or off-road driving
- transporting passengers or goods for hire
- driving under the influence of alcohol, drugs, or impairing medication
9.3 The Company reserves the right to terminate the hire immediately for misuse.
10. Liability and Insurance
10.1 The Hirer is responsible for all costs not covered by any optional insurance or excess reduction purchased.
10.2 Insurance may be void if the Hirer breaches any terms of this Agreement.
11. Return of Vehicle
11.1 The vehicle must be returned on the date, time, and location specified in the Agreement.
11.2 Late returns may incur additional charges.
11.3 Early returns do not qualify for refunds unless expressly agreed.
12. Governing Law
12.1 This Agreement is governed by the laws of Samoa.
12.2 Any disputes shall be resolved in Samoan courts unless otherwise agreed.
